Directive 2002/95/EC of the European Parliament and of the Council of 27 January 2003 on the Restriction of Use of Certain Hazardous Substances in electrical and electronic equipment (the “RoHS Directive”), and all applicable national and regional legislation implementing the RoHS Directive, restricts the following Hazardous Substances: lead, cadmium, mercury, hexavalent chromium, polybrominated biphenyl (PBB), and polybrominated diphenyl ether (PBDE) in excess of certain applicable specified quantity limits. PMC-Sierra certifies that, to the best of its knowledge and belief, the above described part number(s) conform(s) to the requirements of Directive 2002/95/EC RoHS Directive and with Directive 2011/65/EU of the European Parliament and of the Council of 8 June 2011.
PMC-Sierra bases its knowledge and belief on information provided to it by its third party suppliers and makes no warranty as to the accuracy of such information. PMC-Sierra has not independently verified such information and has not conducted destructive testing or chemical analyses of the components and parts supplied by its third party suppliers. PMC-Sierra has relied entirely on certifications of RoHS compliance provided to it by its third party suppliers.
If the recipient of this Declaration and PMC-Sierra have a written contract or other agreement that governs the provision of the identified part(s),the terms and conditions of that agreement, including any limitation of liability and warranty rights and/or remedies that are a part of that agreement, will be the sole and exclusive source of PMC-Sierra’s liability and the recipient’s sole remedies for issues that arise regarding the information PMC-Sierra provides in this Declaration. In the absence of such a written agreement, the limitation of liability and warranty rights and/or remedies of PMC-Sierra’s standard Terms and Conditions of Sale shall apply. In no event shall PMC-Sierra be liable for any indirect, special, incidental, consequential, or other exemplary damages arising out of the information provided herein, or arising out of its provision of non-RoHS compliant parts or materials.
