Adaptec, Inc. Statement Regarding Compliance with National Legislation Implementing the RoHS Directive
The RoHS Directive1 restricts the use and presence of certain hazardous substances2 in new electrical and electronic products placed on the European Union ("EU") market effective July 1, 2006. The Directive is in the process of being implemented into the national laws of the 25 EU Member States. Adaptec is committed to complying with the RoHS Directive and to producing electronic products supplied into the EU which are fully compliant with national implementing legislation on or before the respective effective dates in each Member State.
Some RoHS exemptions will apply to some of Adaptec products, including, for example, lead in solders for servers, storage and storage array systems, which have an exemption until 2010. Adaptec, Inc. certifies as of this date, that to the best of its knowledge and belief, its products either currently conform to the requirements of the RoHS Directive, or will conform to the requirements of the RoHS directive on or before its effective date. Adaptec bases its knowledge and belief on information provided to it by its third party suppliers, and makes no warranty as to the accuracy of such information.
Adaptec has systems in place to endeavor to ensure ongoing compliance with the RoHS Directive. These systems include standard operating procedures that ensure that restricted substances are not utilized in our manufacturing operations, laboratory analytical validation testing, requiring that our third party suppliers provide us with certifications, certifying that the materials they supply to us are RoHS compliant, and an auditing process to ensure that the standard operating procedures are followed.
Efforts are underway to secure material content declarations from each of our contract manufacturers, suppliers, and other third parties. Adaptec has taken and continues to take reasonable steps to provide representative and accurate information but may not have conducted destructive testing or chemical analyses on incoming materials and chemicals. Material content information may not yet be available from some of our suppliers, or the information they supply to us may be erroneous.
To the maximum extent permitted by law, Adaptec shall not be liable for any indirect, special, incidental, consequential or any other exemplary damages arising out of the information provided herein, or arising out of its provision of non-RoHS compliant electronic products or materials.
